These Terms and Conditions ("Terms") govern your use of diabeticsupplyintake.com and any transaction between you and Diabetic Supply Intake ("Diabetic Supply Intake," "we," "us," or "our"). By using our website, contacting us, or selling items to us, you agree to these Terms. Please read them carefully.

1. Who We Are

Diabetic Supply Intake purchases unused, unexpired diabetic supplies and related prescription products from individuals and resells them to licensed wholesale purchasers. We are located at 516 Myrtle Ave, Brooklyn, NY 11205. We are not a pharmacy, we are not a healthcare provider, and we are not affiliated with any product manufacturer.

2. Eligibility

To sell items to us, you must:

• Be at least 18 years of age;
• Be the lawful owner of the items you offer, with the full right to sell them;
• Confirm that the items were legally obtained and are not stolen, and were not acquired through fraud or misrepresentation;
• Confirm that the items are not subject to any return, exchange, or reimbursement obligation to an insurer, government program, pharmacy, or manufacturer.

4. Quotes Are Estimates

Any price we provide before physically inspecting your items is a preliminary estimate based on the description, photographs, reference numbers, and expiration dates you provide. Quotes are not binding offers and are subject to change or withdrawal following inspection. Quotes are valid only for a reasonable period and may be revised if market conditions or wholesale pricing change.

5. Item Condition Requirements

To receive the quoted price, items must meet all of the following conditions:

• The product must be inside its original manufacturer box. Items removed from their box cannot be purchased under any circumstances.
• The item must be unexpired, with sufficient remaining shelf life at the time we receive it.
• Boxes must be in clean, resalable condition. Tears, stains, dents, crushing, water damage, writing, or marker on the box may reduce or eliminate the price we can pay.
• Pharmacy labels must be left intact. Do not attempt to peel, scratch, or remove them, as damage to the label may make the box unsellable.

We reserve the right to decline any item, or to revise our offer, if the item does not meet these requirements upon inspection. If we decline an item that you mailed to us, we will inform you and, at your request and expense, return it to you.

6. Local Pickup

Local pickup is available in parts of New York City and New Jersey, subject to our route schedule and minimum transaction size. Pickup appointments are provided as time windows, not exact times, and may be delayed by traffic or route conditions. We do not guarantee any specific pickup date until it has been confirmed by our team. You are responsible for having the items available and accessible at the confirmed appointment window.

7. Mail-In Program

We provide a free prepaid shipping label for mail-in transactions. You are responsible for packing the items securely and delivering the package to the carrier. Title and risk of loss remain with you until the package is received by us. We are not responsible for packages lost, delayed, or damaged in transit, though we will assist you in filing a carrier claim where possible. Items are inspected and verified after delivery, typically on the next business day. We are closed Sundays and Mondays, and packages arriving on weekends are verified on the next business day.

8. Payment

• Local pickups are paid at the time of pickup, following inspection of the items.
• Mail-in transactions are paid after we receive and verify the package. We do not issue payment before items are received and inspected.
• Available payment methods include Zelle, Venmo, CashApp, Apple Pay, and physical check. Additional methods may be offered at our discretion.
• You are responsible for providing accurate payment details. We are not responsible for funds sent to an incorrect identifier that you supplied.
• Final payment is based on the items actually received and their condition upon inspection, which may differ from a preliminary quote.
• You are solely responsible for any tax obligations arising from the sale of your items.

9. Transaction Minimums

We maintain minimum transaction sizes for both local pickup and mail-in transactions in order to cover operating costs. Current minimums are provided during your conversation with our team and are subject to change. We may decline a transaction that falls below the applicable minimum.

10. Items We Do Not Purchase

• Controlled substances of any kind.
• Expired items.
• Products removed from their original box, or products with no box.
• Damaged, crushed, or water-damaged items, except where a reduced price is expressly agreed for specific eligible product categories.
• Items that are counterfeit, tampered with, or improperly stored.
• Items you do not lawfully own or are not permitted to sell.

11. Your Representations

By selling items to us, you represent and warrant that all information you provide is accurate and complete, that you lawfully own the items, that they were legally obtained, that they have been stored in accordance with the manufacturer's instructions, and that they have not been altered, tampered with, or repackaged. You agree to indemnify and hold us harmless from any claim arising from a breach of these representations.

12. No Medical Advice

Nothing on this website or in any communication from us constitutes medical advice. We do not provide guidance on the use of any product. Consult a licensed healthcare professional regarding your treatment and never discontinue prescribed treatment in order to sell supplies.

13. Website Use

You agree not to misuse this website, including by attempting to gain unauthorized access, interfering with its operation, submitting false information, or using automated systems to scrape or overload it. All content on this website is our property or used with permission and may not be reproduced without our written consent.

14. Third-Party Trademarks

Product names and brands referenced on this website are the trademarks of their respective owners. Diabetic Supply Intake is not affiliated with, endorsed by, or sponsored by Dexcom, Abbott, Insulet, Novo Nordisk, Eli Lilly, or any other manufacturer. References to these brands are made solely to describe the categories of products we purchase.

15. Limitation of Liability

To the fullest extent permitted by law, Diabetic Supply Intake will not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of this website or any transaction with us. Our total aggregate liability for any claim will not exceed the amount we paid or agreed to pay you in the transaction giving rise to the claim.

16. Dispute Resolution and Governing Law

These Terms are governed by the laws of the State of New York, without regard to its conflict of law rules. Any dispute will be brought exclusively in the state or federal courts located in Kings County, New York, and you consent to the jurisdiction of those courts. Before filing any claim, you agree to contact us first so that we may attempt to resolve the matter informally.

17. Changes to These Terms

We may revise these Terms at any time. The updated version will be posted on this page with a new effective date, and it applies to transactions occurring after that date. Your continued use of the website or continued transactions with us constitute acceptance of the revised Terms.
